Liability boundaries and risk allocation principles for WellStreak AI service usage.

1.1 Scope

This Limitation of Liability Policy clarifies liability allocation between WellStreak AI and users/customers of the Services.
This policy supplements the Terms of Service and applies to the maximum extent permitted by applicable law.

2.1 Exclusion of Indirect Damages

WellStreak AI shall not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages.
Excluded damages include loss of profit, loss of data, business interruption, reputational harm, and loss of opportunity arising from use of the Services.

2.2 Third-Party and Integration Risks

WellStreak AI is not liable for outages, API changes, policy restrictions, data handling errors, or service failures caused by third-party providers.
This includes external channel providers, model providers, infrastructure vendors, payment processors, and independent software integrations.

3.1 AI Output Limitation

AI-generated outputs are not guaranteed to be error-free or suitable for all contexts.
WellStreak AI is not liable for decisions made solely on AI outputs without reasonable human review.

3.2 Aggregate Liability Cap

Subject to non-excludable legal rights, WellStreak AI aggregate liability for all claims shall not exceed fees paid by Customer during the three (3) months preceding the claim event.
Claims must be supported by sufficient evidence and brought within applicable legal limitation periods.

4.1 Mandatory Exceptions

Nothing in this policy excludes liability that cannot be legally excluded under applicable law.
Where applicable law imposes mandatory remedies, those remedies remain available to the extent required.

5.1 Governing Law and Dispute Resolution

This policy is governed by laws of India.
Arbitration and jurisdiction terms follow the dispute framework set out in the Terms of Service.

6.1 Updates

WellStreak AI may update this limitation policy to reflect legal, risk, or service changes.
Updated terms apply prospectively from publication date unless otherwise required by law.
